The first crackdowns were reported by the food and restaurant news site, Eater, on Monday, after Manhattan restaurant and bakery Fat Cat Kitchen posted photos zip-lock bagged CBD products marked as 'embargoed' by the New York City Department of Health (DOH).

'Our CBD was embargoed!!! Are they going to do this to every business selling CBD edibles????' Fat Cat captioned it's Instagram post, calling the move an 'arbitrary ban.'

The DOH told NBC that at least 11 other businesses had been ordered to stop selling CBD products, and confirmed the ban.

'Restaurants in New York City are not permitted to add anything to food or drink that is not approved as safe to eat,' the DOH told NBC in a statement.

As of January 25, the Ministry of Health had granted a total of five cultivation licenses to New Zealand organizations. Medsafe group manager Chris James wouldn't comment on who those organizations are, but the Herald is aware that three licenses are held by start-ups Hikurangi Cannabis, Cannasouth and Helius Therapeutics.

James says the Ministry is working through another 45 applications and that others have already been rejected. Still-forming cannabis industry, several Kiwi companies have quickly stuck their heads above the mass around them.

What the six indicate is that there’s no blueprint for entering an industry that doesn’t yet exist. Each company has a unique approach, and as with any start-up scene, it’s anyone’s guess who will survive.

Australia on the way to legalisation

Surprisingly, this one-stop-shop will also make a home Down Under, as Namaste already has a presence in Australia through two online vaporiser stores: NamasteVapes.com.au and Australian Vaporisers.
Dollinger says Namaste is well-poised to take advantage of growth in the medicinal cannabis market in Australia, but there’s a way to go yet in terms of both legislation and public perception.
“If you go into the room and start talking about cannabis people will look at you sideways, even in somewhere like Australia which is full of educated people,” he says.
“But those people will still call it the ‘devil’s weed’, which it’s not. It’s a product that’s proven to be helpful, healthy, and medicinal.”
Despite these perceptions, Dollinger says Namaste still has over half a million Australian customers for its products. He thinks the country is sitting where Canada was a few years ago in terms of softening of attitudes towards legalisation and medicinal cannabis use.
“We’re positioning ourselves for a future in Australia, and I think the industry is all about timing. If you look at Namaste and when we went public, we could not have timed it any better,” he says.
For other companies in Australia hoping to get in on the cannabis industry, Dollinger has a number of key pieces of advice, the first of which is never underestimate the amount of capital you’ll need to get started.
“You’ll need to have very deep pockets. Don’t underestimate how much capital is needed, and you’ll need to have a plan to grow sustainably as buyers fall in love with the product,” he says.
“Also make sure you’re making at least 50% gross margin on your product, otherwise you’re going to find it extremely hard.”
But more generally, for startups looking for new niche markets to go into, Dollinger warns against going into the cannabis growing space, even in Australia. Instead, he urges startups to think outside the box.
“There’s plenty of people growing, so try and think of the added value you can bring to people and where you can have a specialty. I don’t encourage getting into the growing side — it’s called weed for a reason because it grows like one,” he laughs.
“I think there’s a big opportunity in home-grow kits, developing a turnkey solution for growing at home along with finding ways to get people cannabis pre-rolled once it’s legalised.”

A groundbreaking 2016 study conducted by the Australian National University (ANU) found that there was a rapid shift in the public perception of cannabis legalisation between 2013 and 2016. 

The ANU study found that by 2016 the number of Australians who supported legalisation had already skyrocketed to 43%. Only 32% of the population were found to be in opposition, while 22% remained undecided.

Health Minister Greg Hunt said allowing export licences for medicinal cannabis products would improve the viability of domestic producers, thus securing supply for Australian patients.

Hemp vs. Marijuana

Cannabis plants have been cultivated and harvested by humans for thousands of years.

The cannabis plant family includes many different plant types, but none is as controversial (and undeservingly infamous) as marijuana.

Marijuana (or cannabis sativa by its Latin name) is a bushy, short plant particularly loved for its sticky glands. These glands are called trichomes, and they produce THC (tetrahydrocannabinol). THC is a psychotropic substance responsible for giving marijuana users a “stoned” feeling (also known as a high).

Aside from marijuana, there is also the amazing hemp plant.

Hemp is the humble, less-known cousin of marijuana. Hemp can grow to be very tall and is used mostly for industrial purposes. The fibers of hemp trees are very tough, and the oil made from hemp seeds has many uses.

People generally think cannabis oil is made from marijuana. This product is also known as hash oil and is often used to create edible treats. But since hemp is a member of the cannabis family, the highly beneficial hemp oil is another kind of a cannabis oil.

So…hemp oil and marijuana oil: Are they the same thing? How do these two types of cannabis oil differ?

These two oils get their names from the plants they’re extracted from. So let’s take a look at the similarities and differences of the plants to get a foothold in the hemp oil vs. marijuana oil story.
Physical Differences of Marijuana and Hemp Plants

We know that hemp and marijuana are not completely different plants. They are varieties of the same species: the cannabis plant family.

We also know the two varieties have several significant differences. These range from how they grow and look to how they are used and the chemical compounds in their extractions. For instance, hemp grows up to 15 feet tall with long, massive stalks. Marijuana grows outward with more leaves and buds and rarely exceeds five feet tall.

Industrial hemp plants also seem to grow comfortably closely packed together while each marijuana plant requires some space to grow.

The most significant difference, though — especially for the oils — is in the chemical compounds the plants contain.
These are also referred to as cannabinoids.

Hemp and marijuana are two varieties of cannabis grown for different purposes. When people say “cannabis,” they often mean “marijuana.” They don’t realize that cannabis also refers to hemp plants.

Think of it like squares and rectangles. A square is a type of rectangle with four sides of the same length. All squares are rectangles, but not all rectangles are squares.

Hemp Oil vs. Marijuana Oil

The oil extracted from hemp and marijuana plants contains both THC and CBD. The difference is in how much.
Marijuana is usually made up of 5-10% THC, so people consuming marijuana products are likely to have a high. Marijuana is mostly used for recreation, but it’s been recently allowed for medicinal use.
On the other hand, hemp oil contains less than 2% THC but has a high concentration of CBD. This makes it ideal for relaxation without any psychotropic effects.
Those are the differences between hemp and marijuana oils. Now, let’s look more closely at each on its own.

What Is Marijuana Oil?

In short, marijuana oil is a liquid produced by extracting THC from marijuana buds using a solvent. The buds release their fat-soluble compounds (including cannabinoids like THC and CBD) into the solvent. Finally, the mixture is boiled down into marijuana oil.
This type of cannabis oil contains a high amount of THC as well as the other beneficial cannabinoids found in marijuana. The extraction is a long process and should be done carefully, using only high-quality marijuana buds and a good solvent. It is possible to make your own hash oil if you know how.

What Is Hemp Oil?

Hemp oil is made from the seeds and stalks of the hemp plant. The seeds are pressed until the oil comes out.
Hemp oil is created from hemp strains that are very high in CBD but contain only tiny trace amounts of THC. This ensures that you can’t get psychotropic effects from hemp oil but still enjoy the health benefits of CBD.
Cold extraction produces higher-quality hemp oil. When extracted with CO2, hemp oil is generally healthier and contains more desirable compounds.
Unrefined hemp seed oil has a light green color and tastes pleasantly nutty.
Hemp oil is very rich in CBD and contains a nutritious balance of omega 6 and omega 3 fatty acids and linoleic acid. These are essential fats that our bodies need to function properly.


Hemp is a variety of cannabis with low THC levels. All hemp is cannabis, but not all cannabis is hemp. Some types of cannabis a grown for high levels of THC — those are called marijuana.
Hemp Oil is from the Cannabis Sativa plant but only the seed is cold-pressed to obtain the oil. It is also called Hemp Seed Oil.  It is not tested for CBD content but most likely contains a small amount as it is from the Cannabis Sativa Plant.  Hemp Oil is regulated in its production and is tested for THC amounts but is not tested for CBD amounts. 

Industrial Hemp Oil is also from the Cannabis Sativa plant and is the same as Hemp Oil or Hemp Seed OIl. Compared to cannabis Indica, cannabis Sativa (industrial hemp variety) has a much stronger fiber. This fiber can be used in anything from rope and blankets to paper. Marijuana fiber has a low tensile strength and will break or shred easily, making it a poor fibrous plant when compared to industrial hemp. Industrial hemp has low THC levels naturally compared to marijuana specifically cultivated for personal psychoactive use. The reason for the low THC content in hemp is that most THC is formed in resin glands on the buds and flowers of the female cannabis plant. Industrial hemp is not cultivated to produce buds, and therefore lacks the primary component that forms the marijuana high. Furthermore, industrial hemp has higher concentrations of a chemical called Cannabidiol Oil (CBD Oil).

Hemp Extract Oil* and Hemp Oil are from a different Cannabis plant called Cannabis Sativa.  Hemp Extract is made from the entire plant including leaf, seed and stem.  Most oils on the market selling as CBD oil are 97% or more Hemp Seed Oil, mct oil or vegetable glycerine and 3% Hemp Extract. This does not contain THC and is legal in all 50 states.

Hemp Extract- A Canadian hemp oil extract with naturally occurring terpenes, flavonoids, and other beneficial phytonutrients extracted from the hemp plant. This CO2 extracted hemp oil is free of harmful solvents and uses a gentle, low temperature, alcohol free extraction process that yields the purest form of hemp oil extract available. Cannabis Oil* is from the marijuana plant(Cannabis Indicas).  The Cannabis oil is extracted from the leaves of the Cannabis plant.  It contains high levels of THC and lower levels of CBD Oil.  Cannabis Oil is illegal in most states. It is used for medicinal purposes and as a recreational drug.  It is not regulated in its production.
FAQ: Questions and Answers

Q: Is hemp oil the same as Hemp Extract or medicinal cannabis oil?

A: Both made from the same plant. Hemp oil is very beneficial containing a lot of antioxidants and omega 3 and 6 fatty acids. Hemp oil is normally pressed from the seeds of the hemp plant, which means it does not contain the same amount of cannabinoids found in medicinal cannabis oils which are extracted from the whole plant.

Hemp oil does have CBD,  normally less than 25 parts per million (ppm) compared to medicinal cannabis oil extracts that typically contain between 3% and 25% C B D.

Many manufacturers label their CBD products as hemp oil, and a lot of C B D Oil uses hemp oil as the carrier base oil which is what creates some of the confusion.

Cannabis with low levels of THC under 0.3% and high levels of C B D is commonly called Hemp or Industrial hemp. Cannabis with higher levels of THC is sometimes called marijuana or weed. Industrial hemp is normally grown for its fibre and cannabis with high THC has been used medicinally or as a recreational drug far back into antiquity.
